Good Faith Commitment & Liability Waiver

We make every effort to provide the best service. Owing to the essential nature of technology — whereby both Clients and Consultants rely on software and hardware functionality designed / coded / operated by third parties — we cannot make guarantees, especially for factors outside our control. We strive to go the last mile for our Clients in any given situation.

All sales are final. Unused value from an individual retainer is valid for one calendar year following its purchase. It is not refundable. Retainer value older than one calendar year is considered abandoned. Unused value from a time-limited retainer (monthly, daily, weekly, or otherwise agreed upon) is valid for the duration indicated and cannot be carried over or refunded.

Due to the nature of consulting, all hours, including those under retainer, are considered a deliverable, in other words, services received.

PeopleFirst Technology Consulting, its respective consultants, technicians, affiliates, subsidiaries, employees and agents (described herein as “Service”; “we”; “our”) will not be held liable in the event that any alteration, corruption, loss, or damage occurs to Client (also described herein as "you" and "your") hardware, software, data, real or intellectual property during the course of Service’s involvement.

Client agrees to indemnify, defend and hold harmless Service from and against any and all liability, claims, costs and expenses (including without limitation reasonable legal fees and expenses), arising out of, resulting from, or in connection with, Client’s involvement with Service. Client agrees to waive and invalidate the use of credit card dispute resolution commonly referred to as a chargeback as a method of resolving disputes.

Statement Descriptors

We don't want you to see a charge you don't recognize

Client understands that Service does not have complete control over the appearance of our name as it may appear on your financial statement (this is commonly known as a Statement Descriptor). Banks and credit card processors impose varying limitations on wording.

Statement Descriptors for our services that may appear on your financial statement include but are not limited to the following words, contact info, and logical variations: PeopleFirst;; Tech Support; Consulting; 413-461-0617. Client will take all reasonable precautions to avoid an unnecessary fraud dispute due to an unrecognized charge, and Service reserves the right to charge a reasonable fee to cover the time and cost involved in resolving such situations.

We work on retainer

Retainers are the best way to account for technical work that cannot be 100% specified at the time of contracting. Generally for basic house calls, payment is due upon completion of the day's work. We require retainers for projects expected to last more than one day.

Using our online payment portal that you can access securely at any time, you can see itemized invoices, check remaining credit, and see a full account statement, etc.

Cancellation policy

We reserve the right to assess a cancellation fee of 50% for bookings cancelled between 1 – 24 hours prior to the appointment time, or 100% for cancellations of less than one hour or no-shows.

Work on existing websites and systems

Reputable building contractors include a clause about unforeseen circumstances; in this respect, work on an existing website, project, server, or archive of files is very similar. Like dry rot or termite damage behind a wall, hidden conditions — broken code, incompatible plugins, digital files or other source material that require cleanup / organizing, or other functionality that needs fixing — may not be apparent at the time of budgeting.

Through the use of our website, the information within, and/or our services, you agree to be bound in entirety and perpetuity to the terms of this Agreement. This Agreement supersedes any prior verbal or written arrangement. If any portion of this Agreement is deemed invalid, the remainder shall survive said portion.
